Program Summary

What Will You Learn

Attorneys will learn federal and state regulatory frameworks, ownership structures, corporate practice of medicine doctrine, licensure, and delegation rules governing medical spas.

What Will You Gain

Attorneys will gain a complete, practice-ready legal framework for advising, structuring, defending, and litigating medical spa issues.

Key topics to be discussed:

  • Federal compliance

HIPAA, OSHA, and FDA regulations apply to all med spa operations.

  • State variability

Medical, nursing, and cosmetology boards enforce differing scope-of-practice limitations by state.

  • Ownership models

Physician-owned entities, lay ownership, and MSO hybrid structures present distinct legal considerations.

  • CPOM doctrine

Corporate practice of medicine rules vary between strict and permissive states.

  • Scope delegation

Physicians, NPs, PAs, RNs, and estheticians operate under distinct delegation authority.

  • Operational risk

Patient intake, informed consent, recordkeeping, and marketing practices create significant liability exposure.
