Program Summary

Trials in wage and hour class and collective actions are rare, and many employers rationally choose to settle disputes rather than endure a costly discovery process and an even more costly jury trial. Through that lens, efficient use of discovery can work hand in glove with a settlement strategy that reduces litigation and settlement costs while bringing a faster, effective resolution to class-wide or collective claims.

Key topics to be discussed:

  • Methods for streamlining pre-settlement discovery processes
  • Key topics and methods for effective wage and hour discovery
  • Different approaches for determining settlement value inside and outside of alternative dispute resolution processes
  • How the mechanics of class and collective action certification play a role in different approaches to settlement
